These Terms of Service (“Terms”) govern your access to and use of Inviteable (the “Service”), operated by Inviteable (“we,” “us,” or “our”). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. By using the Service, you represent that you meet this requirement and have the legal capacity to enter into a binding contract.

2. Your Account

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must provide accurate registration information and promptly update it if it changes. You may not share, sell, or transfer your account to anyone else.

3. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You will not, and will not allow others to:

Send invitations to recipients without their consent or where doing so would violate applicable anti-spam laws (including CAN-SPAM, GDPR, CCPA, and equivalent local laws).
Use the Service to plan, promote, advertise, or facilitate any illegal activity, including but not limited to: drug distribution, illegal gambling, weapons sales, human trafficking, sexual exploitation, child exploitation, terrorism, money laundering, tax evasion, fraud, or any other criminal conduct.
Send invitations that contain content that is defamatory, obscene, pornographic, sexually explicit, harassing, threatening, hateful, racist, discriminatory, or that promotes violence or self-harm.
Impersonate any person or entity, misrepresent your affiliation with any person or entity, or forge headers or otherwise manipulate identifiers to disguise the origin of any content transmitted through the Service.
Use the Service to send phishing emails, malware, viruses, spyware, or any harmful code.
Collect or harvest personal information of guests beyond what is necessary to host the stated event, or use guest data for marketing, resale, or any purpose other than the event itself.
Use the Service to harass, abuse, stalk, intimidate, or threaten any person.
Promote, organize, or facilitate events involving minors in a way that endangers their safety or violates child protection laws.
Attempt to gain unauthorized access to the Service, other accounts, or our systems; probe, scan, or test the vulnerability of our systems; circumvent rate limits, security, or authentication measures.
Reverse engineer, decompile, scrape, or copy any portion of the Service.
Use the Service to compete with us, including by using it to build a substantially similar product.
Upload, store, or transmit any content that infringes intellectual property rights (including copyrights, trademarks, and rights of publicity) of third parties.

4. Content You Provide

You retain ownership of the event details, custom images, guest lists, and messages you upload (“Your Content”). By uploading Your Content, you grant us a limited, worldwide, royalty-free license to host, store, transmit, and display Your Content solely for the purpose of providing the Service to you. You represent that you have all rights and permissions necessary to upload Your Content and that it does not violate any law or third party right.

5. Payment

The Service is offered on a per-event basis at the price displayed at checkout (currently $5 per event for up to 100 guests, subject to change). Payments are processed by our payment processor. All sales are final except as provided in our refund policy. We may refuse or cancel any order at our discretion, including for suspected fraud or violation of these Terms.

6. Refund Policy

We offer a 7-day money-back guarantee from the date of your payment. To request a refund, contact us at support@inviteable.app within 7 days. Refunds are not available after invitations have been sent to a majority of your guest list, or where we determine the refund is being used to abuse the Service.

7. Reporting Abuse

If you believe any user of the Service is violating these Terms — including using the Service for illegal activity, harassment, or spam — please report it to abuse@inviteable.app. We take reports seriously and investigate them promptly.

8. Suspension & Termination

We may suspend or terminate your account at any time, with or without notice, if we reasonably believe you have violated these Terms, applicable law, or have engaged in conduct we determine to be harmful to other users, third parties, or our business. Upon termination, your right to use the Service ceases immediately, and we may delete Your Content. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and dispute resolution) will survive.

9. Intellectual Property

The Service, including all designs, templates, software, branding, and content (other than Your Content), is owned by Inviteable or its licensors and protected by copyright, trademark, and other laws. You are granted a limited, non-exclusive, non-transferable license to use the Service solely for your personal, non-commercial event hosting purposes. All other rights are reserved.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OPERATION. WE DO NOT GUARANTEE DELIVERY OF ANY EMAIL OR THAT INVITATIONS WILL REACH RECIPIENTS' INBOXES. YOU USE THE SERVICE AT YOUR OWN RISK.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INVITEABLE AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR $50, WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify and hold harmless Inviteable and its officers, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) Your Content; (c) your violation of these Terms or applicable law; or (d) your violation of any third-party right.

13. Changes to Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated effective date. Continued use of the Service after changes take effect constitutes acceptance.

14. Governing Law & Disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Service will be resolved in the courts located in the State of Delaware, United States, and you consent to personal jurisdiction and venue there.
